Objections as to misjoinder
Full Text
All objections on the ground of misjoinder of causes of action shall be taken at the earliest possible opportunity and, in all cases where issues are settled, at or before such settlement, unless the ground of objection has subsequently arisen, and any such objection not so taken shall be deemed to have been waived.
Plain English Summary
Mandates that objections regarding misjoinder of causes of action must be raised at the earliest threshold at or before settlement of issues, failing which they are statutorily deemed waived.
Key Legal Elements
- Strict Statutory Window: Objection must be pleaded in the Written Statement before or at settlement of issues.
- Statutory Deemed Waiver: Complete bar against raising misjoinder of causes of action at trial arguments, first appeal, or second appeal if not raised timely.
- Exceptions: Permissible subsequently only if the factual ground of objection arose after the framing of issues.
Practical Note
Pleading Strategy & Deemed Waiver Rule: 1. Mandatory Written Statement Clause: Defendant must plead in preliminary objections: 'The suit is bad for misjoinder of causes of action and multifariousness, and is liable to be rejected/bifurcated under Order II Rule 6 & 7 CPC'. 2. Appellate Bar: In Shew Kissen Bhatter v. Ram Kissen Rai (AIR 1973 Cal 183), the court reaffirmed that misjoinder of causes of action is a mere irregularity cured by failure to object before issues are settled. 3. Framing Preliminary Issue: Insist that the court frame a preliminary issue on multifariousness / misjoinder under Order XIV Rule 2.
