Joinder of causes of action

Full Text

(1) Save as otherwise provided, a plaintiff may unite in the same suit several causes of action against the same defendant, or the same defendants jointly; and any plaintiffs having causes of action in which they are jointly interested against the same defendant or the same defendants jointly may unite such causes of action in the same suit.

(2) Where causes of action are united, the jurisdiction of the Court as regards the suit shall depend on the amount or value of the aggregate subject-matters at the date of instituting the suit.

If the total exceeds the pecuniary ceiling of a Junior Civil Judge, file before Senior Civil Judge / District Court directly. 2. Multifariousness Trap: If Plaintiff joins different defendants on totally separate and unconnected causes of action, the suit is bad for multifariousness (misjoinder of parties AND causes of action). 3. Commercial Debts: A creditor can aggregate invoices/shipments of various dates against the same customer under Rule 3.

(1) अन्यथा उपबंधित के सिवाय, कोई वादी एक ही प्रतिवादी के विरुद्ध या उन्हीं प्रतिवादियों के विरुद्ध संयुक्ततः कई वाद-हेतुकों को एक ही वाद में संयुक्त कर सकेगा; तथा जिन वादियों के ऐसे वाद-हेतुक हैं जिनमें वे उसी प्रतिवादी के विरुद्ध या उन्हीं प्रतिवादियों के विरुद्ध संयुक्ततः हितबद्ध हैं, वे ऐसे वाद-हेतुकों को एक ही वाद में संयुक्त कर सकेंगे।

(2) जहां वाद-हेतुकों को संयुक्त किया जाता है वहां वाद के संबंध में न्यायालय की अधिकारिता वाद संस्थित करने की तारीख पर संकलित विषय-वस्तुओं (Aggregate subject-matters) की रकम या मूल्य पर निर्भर करेगी।
