Plaints in suits by or against Government
Full Text
In suits by or against the Government, instead of inserting in the plaint the name and description and place of residence of the plaintiff or defendant, it shall be sufficient to insert the appropriate name as provided in section 79.
Plain English Summary
Dispenses with individual names and addresses in government litigation, mandating the use of the constitutional nomenclature prescribed under Section 79 of the Code (i.e., 'Union of India' or the concerned 'State of [Name]').
Key Legal Elements
- Exemption from Order VII Rule 1: No requirement to describe individual officer's personal name or residential address.
- Mandatory Section 79 Alignment: Must be styled as 'Union of India' for Central Government and 'State of...' for State Government.
- Departmental Description: Sued through the Secretary or head of the concerned administrative department.
Practical Note
Fatal Misdescription of Parties: 1. Suing a Department Directly is Void: A suit filed against 'The Department of Telecommunications' or 'The Public Works Department' without impleading 'Union of India' or 'State of...' through its Secretary is incompetent and liable to rejection under Section 79 read with Order XXVII Rule 3 (Chief Conservator of Forests v. Collector (2003) 3 SCC 472). 2. Curing Defect: If inadvertently misdescribed, immediately move under Order I Rule 10 to amend the cause title before the trial commences.
