Full Text
Persons being ex officio or otherwise authorised to act for the Government in respect of any judicial proceeding shall be deemed to be recognised agents by whom appearances, acts and applications under this Code may be made or done on behalf of the Government.
Plain English Summary
Confers the legal status of recognized agents under Order III upon ex-officio and specially authorized public officers to appear, act, and file applications on behalf of the Government in judicial proceedings.
Key Legal Elements
- Legal Fiction: Ex-officio / authorized officers deemed 'recognized agents' under Order III Rule 2.
- Scope of Authority: Appearances, applications, vakalatnamas, affidavits, and procedural steps.
- Proof of Authority: Production of government gazette notification or specific executive sanction letter.
Practical Note
Production of Authority Letter: While private litigants must execute a formal registered/stamped power of attorney or vakalatnama, a government officer acting under Rule 2 only needs to place on record an attested copy of the departmental authorisation letter or notification empowering them to represent the department.
