Court to fix a time for return of commission
Full Text
The Court issuing a commission shall fix a date on or before which the commission shall be returned to it after execution, and the date so fixed shall not be extended except where the Court, for reasons to be recorded, is satisfied that there is sufficient cause for extending the date.
Plain English Summary
Mandates that courts must specify a strict return date for execution of commissions, prohibiting arbitrary extensions and requiring recorded judicial reasons demonstrating sufficient cause.
Key Legal Elements
- Mandatory Return Deadline: Issuing order must specify fixed calendar return date.
- Statutory Restriction on Extensions: Prohibits casual adjournments.
- Recorded Reasons: Judge must record speaking order explaining genuine cause of delay (e.g. monsoon flooding, illness).
Practical Note
Curtailing Adjournment Abuse: Where the adversary uses the pending commission to stall the trial, invoke Rule 18B to insist that either the report be submitted on the scheduled date or the commission be forfeited/recalled for want of sufficient cause.
