Parties to appear before Commissioner

Full Text

(1) Where a commission is issued under this Order, the Court shall direct that the parties to the suit shall appear before the Commissioner in person or by their agents or pleaders.

(2) Where all or any of the parties do not so appear, the Commissioner may proceed in their absence.

Plain English Summary

Mandates judicial direction for parties to appear before the commissioner personally or through counsel, empowering the commissioner to proceed ex parte under sub-rule (2) if a party fails to appear despite due service of notice.

Key Legal Elements

  • Mandatory Appearance Direction: Court order issuing commission must expressly direct appearance of parties.
  • Representation: Personal appearance, authorized recognized agent, or advocate.
  • Ex Parte Power (Sub-rule 2): Commissioner can conduct the spot inspection or examination in absentia if proper notice was served.

Practical Note

Service of Prior Notice is Sine Qua Non: 1. Notice Mandatory: An ex-parte commissioner report executed without serving advance written notice specifying date and time to all parties is illegal and will be quashed by the court. 2. Panchanama of Service: Ensure the commissioner obtains written endorsements of service or sends registered speed post/WhatsApp notices with proof before visiting the spot.
