Dispossession by decree-holder or purchaser
Full Text
(1) Where any person other than the judgment-debtor is dispossessed of immovable property by the holder of a decree for the possession of such property or, where such property has been sold in execution of a decree, by the purchaser thereof, he may make an application to the Court complaining of such dispossession.
(2) Where any such application is made, the Court shall proceed to adjudicate upon the application in accordance with the provisions herein contained.
Plain English Summary
Provides a summary restitution remedy for innocent third parties (other than the debtor) dispossessed during warrant execution, compelling the executing court to adjudicate their independent title and restore possession.
Key Legal Elements
- Third-Party Shield: Available strictly to persons other than the judgment-debtor.
- Post-Dispossession Remedy: Triggered after actual physical dispossession has occurred.
- Mandatory Trial: Executing court must adjudicate rights under Rule 101; cannot relegate to separate suit.
- Thirty-Day Limitation: Governed by Article 128 of the Limitation Act (30 days from date of dispossession).
Practical Note
Restoring Wrongfully Evicted Strangers: 1. Landmark Authorities - Shreenath v. Rajesh (1998) 4 SCC 543 & N.S.S. Narayana Sarma v. Goldstone Exports (P) Ltd. (2002) 1 SCC 662: A lawful tenant or independent owner dispossessed under color of a decree against a third party must apply under Rule 99 within 30 days. The court must hold a full trial and restore possession. 2. Strategy: Always file a stay/status quo application under Section 151 along with the Rule 99 petition to prevent the decree-holder from demolishing the building or inducting new tenants.
