Certificate to purchaser

Full Text

Where a sale of immovable property has become absolute, the Court shall grant a certificate specifying the property sold and the name of the person who at the time of sale is declared to be the purchaser. Such certificate shall bear date the day on which the sale became absolute.

Plain English Summary

Mandates the grant of a formal Sale Certificate to the auction purchaser once the sale becomes absolute, constituting conclusive document of title bearing the date on which the sale became absolute.

Key Legal Elements

  • Issuance of Sale Certificate: Mandatory statutory document of title issued under court seal.
  • Specification of Boundaries: Accurate property schedule matching proclamation.
  • Dating of Certificate: Formally bears date on which sale became absolute under Rule 92.
  • Registration Exemption: Exempt from compulsory registration under Section 17(2)(xii) of the Registration Act, 1908.

Practical Note

Sale Certificate and Registration Law: 1. Landmark Precedent - B. Arvind Kumar v. Govt. of India (2007) 5 SCC 745: A Sale Certificate issued by a court under Order XXI Rule 94 does not require registration under Section 17(1) of the Registration Act, as it falls squarely within the statutory exemption of Section 17(2)(xii). Sending a copy to the Sub-Registrar under Section 89(4) of the Registration Act is sufficient to update the Book-1 encumbrance records. 2. Stamp Duty Requirement: While registration is exempt, stamp duty under the relevant State Stamp Act must be paid on the sale certificate before it is admitted in evidence.

हिंदी पाठ
