Determination of attachment
Full Text
(1) Where any property has been attached in execution of a decree and the Court, for any reason, passes an order dismissing the application for the execution of the decree, the Court shall direct whether the attachment shall continue or cease and shall also indicate the period up to which such attachment shall continue or the date on which such attachment shall cease.
(2) If the Court omits to give such direction, the attachment shall be deemed to have ceased.
Plain English Summary
Governs the consequences of dismissing an execution application upon subsisting attachments: mandates the court to specify whether attachment continues or ceases, providing that judicial omission automatically causes the attachment to lapse.
Key Legal Elements
- Duty to Specify Status (Sub-rule 1): Executing court must expressly state continuance/cessation with dates.
- Automatic Cessation Default Rule (Sub-rule 2): Judicial silence or omission automatically extinguishes attachment.
- Applies to All Dismissals: Applies whether execution is dismissed for default of decree-holder or on merits.
- Section 64 Protection Ceases: Upon cessation under Rule 57, the debtor can lawfully alienate the property.
Practical Note
Vigilance Against Dismissal of Execution: 1. Landmark Authorities - Shivashankar Prasad Shah v. Baikunth Nath Singh AIR 1969 SC 971 & V.D. Modi v. R.A. Rehman (1970) 1 SCC 670: Under Rule 57(2), if the execution petition is dismissed for default or statistical reasons and the court fails to expressly state that attachment continues, the attachment immediately lapses. Any subsequent alienation by the judgment-debtor becomes completely valid! 2. Golden Rule for Advocates: If the execution petition is being dismissed with liberty to file afresh or consigned to record room, insist that the presiding officer expressly record: 'Attachment of property ordered on [Date] shall continue for a period of six months / until further orders.'
(Omits to give such direction), तो यह समझा जाएगा कि कुर्की समाप्त हो गई है (Attachment shall be deemed to have ceased)।
