Mode of transfer

Full Text

Where a decree is to be sent for execution to another Court, the Court which passed such decree shall send the decree directly to such other Court whether or not such other Court is situated in the same State, but the Court to which the decree is sent for execution shall, if it has no jurisdiction to execute the decree, send it to the Court having such jurisdiction.

Plain English Summary

Mandates direct transmission of a decree for execution from the court which passed it to the transferee court across district and state borders, eliminating the redundant procedural detour of routing through District Courts.

Key Legal Elements

  • Direct Inter-Court Transmission: Court-to-court direct dispatch across India.
  • Cross-State Transmission: Operates irrespective of whether destination is within or outside the State.
  • Jurisdictional Redirection: Transferee court lacking jurisdiction automatically transmits to the competent territorial court.

Practical Note

Fast-Track Transfer of Decrees under Order XXI Rule 5: 1. 1976 Amendment Effect: Prior to 1976, decrees transferred to another district had to be routed through the District Judge. Rule 5 now permits direct transmission from Court A (Civil Judge, Rewari) directly to Court B (Civil Judge, Jaipur). 2. Drafting Transfer Application: File an 'Application under Section 39 read with Order XXI Rule 5 CPC for direct transfer of decree to the Court of Senior Civil Judge, Gurugram, where the judgment-debtor owns properties'.
