Decree for delivery of immovable property when in occupancy of tenant

Full Text

Where a decree is for the delivery of any immovable property in the occupancy of a tenant or other person entitled to occupy the same and not bound by the decree to relinquish such occupancy, the Court shall order delivery to be made by affixing a copy of the warrant in some conspicuous place on the property, and proclaiming to the occupant by beat of drum or other customary mode, at some convenient place, the substance of the decree in regard to the property.

Plain English Summary

Prescribes the mode of delivering symbolical or proprietary possession of immovable property occupied by lawful tenants who are not bound to vacate, executed via warrant affixation and drum proclamation.

Key Legal Elements

  • Symbolical Possession: Operates where occupant has lawful tenancy rights not terminated by decree.
  • Protection of Lawful Tenants: Tenant cannot be physically evicted under Rule 35 if not bound by decree.
  • Attornment Effect: Proclamation establishes attornment of tenancy to the decree-holder.
  • Drum Proclamation (मुनादी) Mandatory: Substance of decree read out at the spot.

Practical Note

Symbolical Possession vs. Physical Possession: In Balwant Narayan Bhagde v. M.D. Bhagwat (1975) 4 SCC 705, the Supreme Court clarified that where the property is in the hands of a tenant entitled to occupy, delivery under Rule 36 is symbolical. From the date of proclamation, the tenant becomes tenant of the decree-holder and must pay rent to him.
