Order of Court which passed decree or of Appellate Court to be binding upon Court applied to

Full Text

Any order of the Court by which the decree was passed, or of such Court of appeal as aforesaid, in relation to the execution of such decree, shall be binding upon the Court to which the decree was sent for execution.

Plain English Summary

Establishes that all orders passed by the decree-passing court or the appellate court regarding execution or stay are strictly binding upon the transferee executing court.

Key Legal Elements

  • Hierarchical Binding Precedence: Original decree court and appellate court orders override transferee court.
  • Absolute Compliance: Transferee court cannot sit in appeal or refuse implementation.
  • Immediate Cessation upon Appellate Stay: Transferee court must drop tools the moment stay order is brought on record.

Practical Note

Transferee Court Bound by Superior Orders: The executing court on transfer cannot question the correctness of stay orders or conditional modifications granted by the parent court or appellate court. A certified copy of the appellate order filed by memo mandates instant compliance.
