Liability of judgment-debtor discharged

Full Text

No order of restitution or discharge under rule 26 shall prevent the property or person of a judgment-debtor from being retaken in execution of the decree sent for execution.

Plain English Summary

Clarifies that interim restitution of property or release of the judgment-debtor under Rule 26 does not confer immunity; if the stay application fails, property and person remain fully subject to re-seizure.

Key Legal Elements

  • Interim Nature of Rule 26 Orders: Discharge/restitution is strictly provisional.
  • Re-taking in Execution: Immediate resumption of coercive processes upon dismissal of debtor's stay motion.
  • No Double Jeopardy Defense: Civil arrest can be re-executed since initial release was conditional.

Practical Note

Execution Resumption Strategy: If the judgment-debtor fails to obtain a stay from the appellate court within the period stipulated under Rule 26, the decree-holder should immediately file a memo for reviving coercive execution without needing a fresh execution petition.
