Application for arrest to state grounds

Full Text

Where an application is made for the arrest and detention in prison of the judgment-debtor, it shall state, or be accompanied by an affidavit stating, the grounds on which arrest is applied for.

Plain English Summary

Mandates that every application seeking the arrest and civil imprisonment of a judgment-debtor must be supported by an affidavit detailing the specific grounds warranting incarceration under Section 51 CPC.

Key Legal Elements

  • Affidavit of Grounds: Mandatory statutory requirement.
  • Harmonization with Section 51 CPC: Must establish dishonest concealment, fraudulent transfer, or contumacious refusal to pay despite having means.

Practical Note

Overcoming Jolly George Varghese Standard: 1. Landmark Ruling - Jolly George Varghese v. Bank of Cochin (1980) 2 SCC 360: The Supreme Court held that mere poverty or inability to pay a debt is NOT a ground for arrest under Section 51 and Rule 11A. There must be some element of bad faith, fraudulent transfer, or obstinate refusal to pay despite possessing means. 2. Affidavit Contents: The Rule 11A affidavit must specifically aver: 'The judgment-debtor has sufficient means (owning bank accounts, vehicles, or business turnover) but is wilfully evading payment with dishonest intent to defeat the decree'.
