Plain English Summary
Prescribes the mandatory 10-column tabular format for written execution applications, while empowering courts to order immediate arrest of a judgment-debtor present in the courtroom upon oral motion in money decrees.
Key Legal Elements
- Immediate Oral Arrest (Sub-rule 1): Summary arrest of judgment-debtor within court precincts upon oral prayer.
- Mandatory 10-Column Tabular Format (Sub-rule 2): Standardized execution petition columns (a) to (j).
- Five Execution Assistance Modes (Sub-rule 2(j)): (i) Specific delivery; (ii) Attachment & sale; (iii) Civil arrest; (iv) Receiver; (v) Residual.
- Signed & Verified: Same stringency as verification of pleadings under Order VI Rule 15.
- Certified Copy Prerequisite (Sub-rule 3): Court's power to demand production of decree copy.
Practical Note
Drafting the Tabular Execution Petition: 1. Non-Compliance Rejection: Defective columns in the Rule 11 tabular format (e.g. failing to disclose previous execution petitions in Column f or omitting exact calculation of interest in Column g) will result in objection under Rule 17. 2. Column (j) Strategy: Never select just one mode of assistance; always write: 'By attachment and sale of the immovable properties in the Schedule, and failing realization, by arrest and detention of the judgment-debtor in civil prison'.
