Orders to be treated as decrees

Full Text

Where any application has been adjudicated upon under rule 98 or rule 100, the order made thereon shall have the same force and be subject to the same conditions as to an appeal or otherwise as if it were a decree.

Plain English Summary

Accords the full status and force of a formal decree to orders passed under Rule 98 (allowing/dismissing resistance) or Rule 100 (dispossession claims), subjecting them to regular First Appeal under Section 96 CPC.

Key Legal Elements

  • Deemed Decree Status: Conclusive adjudication of title and possessory rights.
  • First Appeal Remedy: Regular appeal under Section 96 CPC to District Judge / High Court.
  • Second Appeal Available: Second appeal lies to the High Court under Section 100 on substantial questions of law.
  • Revision Barred: Civil Revision under Section 115 CPC is legally barred.

Practical Note

Appellate Remedies Against Possession Orders: In Sameer Singh v. Abdul Rab (2015) 1 SCC 379, the Supreme Court emphasized that an order under Rule 98 or Rule 100 is a deemed decree under Rule 103. Therefore, no revision under Section 115 or writ petition under Article 227 lies against such an order. The aggrieved party must file a regular First Appeal under Section 96 CPC with ad valorem court fees.
