Rules not applicable to transferee lite pendente

Nothing in rules 98 and 100 shall apply to resistance or obstruction in execution of a decree for the possession of immovable property by a person to whom the judgment-debtor has transferred the property after the institution of the suit in which the decree was passed or to the dispossession of any such person.
Explanation.—In this rule, “transfer” includes a transfer by operation of law.

नियम 98 और नियम 100 की कोई भी बात किसी ऐसे व्यक्ति द्वारा स्थावर संपत्ति के कब्जे की डिक्री के निष्पादन में किए गए प्रतिरोध या बाधा को, जिसे निर्णय-ऋणी ने उस वाद के संस्थित किए जाने के पश्चात जिसमें डिक्री पारित की गई थी, संपत्ति अंतरित की है, अथवा ऐसे किसी व्यक्ति के बेकब्जा किए जाने को लागू नहीं होगी।
स्पष्टीकरण— इस नियम में “अंतरण” के अंतर्गत विधि की क्रिया द्वारा अंतरण (Transfer by operation of law) भी सम्मिलित है।
