Court to state its decision on each issue

Full Text

In suits in which issues have been framed, the Court shall state its finding or decision, with the reasons therefor, upon each separate issue, unless the finding upon any one or more of the issue is sufficient for the decision of the suit.

Plain English Summary

Commands the Court to record distinct findings with reasons upon every individual framed issue, unless an anterior finding on a threshold issue (e.g. jurisdiction or maintainability) conclusively disposes of the suit.

Key Legal Elements

  • Issue-Wise Adjudication: Prevents sweeping, generalized judgments.
  • Independent Reasoning for Each Issue: Essential for appellate clarity.
  • Threshold Exception: Single-issue disposal allowed where a preliminary point of law (e.g., res judicata, court fee) bars the suit.

Practical Note

Why Appellate Courts Insist on All-Issue Findings: The Supreme Court has repeatedly held that trial courts should record findings on all issues rather than disposing of the suit on a preliminary point alone, so that if the appellate court reverses the preliminary finding, a remand is avoided.
