Judgments of Small Cause Courts and other Courts
Full Text
(1) Judgments of a Court of Small Causes need not contain more than the points for determination and the decision thereon.
(2) Judgments of other Courts.—Judgments of other Courts shall contain a concise statement of the case, the points for determination, the decision thereon, and the reasons for such decision.
Plain English Summary
Contrasts concise judgments of Small Cause Courts (points for determination and findings) with regular civil courts, which must contain pleadings summary, points for determination, findings, and reasoned judicial rationale.
Key Legal Elements
- Small Cause Streamlined Form (Sub-rule 1): Only points for determination + decision.
- Four Pillars of Regular Civil Judgments (Sub-rule 2): (1) Concise statement of facts; (2) Points for determination / Issues; (3) Judicial decision; (4) Cogent reasons.
- Absence of Reasons Vitiates Judgment: Unreasoned civil judgments are liable to be set aside in First Appeal under Section 96.
Practical Note
Challenging Unreasoned Judgments in First Appeal: If a trial court passes an order saying 'Issue No. 1 is decided in favour of the plaintiff' without discussing the oral and documentary evidence, attack it under Order XX Rule 4(2) CPC as a non-speaking judgment that fails the statutory mandate of recording reasons.
