Section O1R4Procedural

Court may give judgment for or against one or more of joint parties

Full Text

Judgment may be given without any amendment—

(a) for such one or more of the plaintiffs as may be found to be entitled to relief, for such relief as he or they may be entitled to;

(b) against such one or more of the defendants as may be found to be liable, according to their respective liabilities.

Plain English Summary

Authorizes the court to pronounce judgment in favor of entitled plaintiffs or against liable defendants without requiring formal amendment of the pleadings.

Key Legal Elements

  • No Plaint Amendment Necessary: Judgment can be modulated directly on the evidence on record without technical amendments.
  • Severable Reliefs: Partial decree can be passed for qualifying plaintiffs even if other co-plaintiffs fail to establish their claims.
  • Apportionment of Liability: Decrees may determine individual or proportionate liabilities among multiple defendants.

Practical Note

Courtroom Guidance: 1. Pragmatic Adjudication: Prevents the collapse of a genuine claim of one plaintiff merely because a joined co-plaintiff failed to establish his entitlement. 2. Decreeing Apportioned Liability: Advocates for defendants should urge individual apportionment of liability under clause (b) to avoid joint and several execution burdens where liabilities are distinct.
