Power to order separate trials where joinder of defendants may embarrass or delay trial
Full Text
Where it appears to the Court that any joinder of defendants may embarrass or delay the trial of the suit, the Court may order separate trials or make such other order as may be expedient in the interests of justice.
Plain English Summary
Empowers the trial court to order separate trials against joined defendants if their collective trial would cause procedural embarrassment, prejudice, or delay.
Key Legal Elements
- Statutory Safeguard for Defendants: Inserted by 1976 CPC Amendment to counterpart Rule 2 for plaintiffs.
- Grounds: Joinder tends to embarrass the defense, prolong the trial, or prejudice fair adjudication.
- Judicial Order: Court may bifurcate the trial into separate proceedings or structure proceedings expediting justice.
Practical Note
Courtroom Strategy for Defense Advocates: 1. Application Header: 'Application under Order I Rule 3A read with Section 151 CPC for Separate Trials of Defendants'. 2. Key Tactical Utility: Useful in commercial and complex property disputes where a peripheral defendant with a minor, distinct issue is unnecessarily tied to an extensive multi-party trial. 3. Procedural Timing: Raise at the time of filing written statement or before the settlement of issues.
