Questions objected to and allowed by Court
Full Text
Where any question put to a witness is objected to by a party or his pleader, and the Court allows the same to be put, the Judge shall take down the question, the answer, the objection and the name of the person making it, together with the decision of the Court thereon.
Plain English Summary
Mandates that where an objection to a question is raised but overruled by the court, the judge must record the exact question, answer, objection, objecting counsel's name, and the judicial ruling.
Key Legal Elements
- Five Mandatory Entries: (1) The question, (2) The answer, (3) The objection raised, (4) Name of objecting pleader/party, (5) Court's ruling.
- Appellate Scrutiny: Provides complete record for the appellate court to review the admissibility of the question.
Practical Note
Creating Appellate Grounds for Inadmissible Evidence: If opposing counsel asks an improper leading question on a material matter or seeks hearsay evidence, object formally under Rule 11. Even if the trial judge overrules it, the objection is preserved on record for the High Court in appeal.
