Any particular question and answer may be taken down

Full Text

The Court may, of its own motion or on the application of any party or his pleader, take down any particular question and answer, or any objection to any question, if there appears to be any special reason for so doing.

Plain English Summary

Authorizes the Court suo motu or on motion to record any critical question and answer verbatim, along with any objection, where special reasons warrant exact quotation.

Key Legal Elements

  • Verbatim Q&A Recording: Deviates from continuous narrative form for crucial questions.
  • Special Reason Requirement: E.g., admissions of fraud, contradictory statements, or evasions.
  • Recording Objections: Memorializes disputed questions on the evidentiary record.

Practical Note

Pinning Down Perjury under Rule 10: When a witness gives a startling admission or completely contradicts their earlier affidavit, counsel should orally request: 'May this specific question and the witness's exact answer be taken down verbatim under Order XVIII Rule 10 CPC'.
