Endorsements on documents rejected as inadmissible in evidence
Full Text
Where a document relied on as evidence by either party is considered by the Court to be inadmissible in evidence, there shall be endorsed thereon the particulars mentioned in clauses (a), (b) and (c) of rule 4, sub-rule (1) together with a statement of its having been rejected, and the endorsement shall be signed or initialled by the Judge.
Plain English Summary
Requires the presiding judge to make a signed endorsement on any rejected document stating the suit particulars, date, producer name, and an express statement that the document has been rejected as inadmissible.
Key Legal Elements
- Judicial Rejection Endorsement: Prevents rejected documents from being surreptitiously cited later as admitted evidence.
- Preserves Appellate Review: Rejected document remains identifiable for appellate scrutiny under Order XLI Rule 27.
- Judicial Initials: Obligatory signature or initials of presiding judge.
Practical Note
Marking for Identification vs. Rejection: If a document is inadmissible, the judge marks it 'Rejected under Order XIII Rule 6 CPC - Signed [Judge]'. Alternatively, if only proof is pending, courts mark it as 'Mark A' or 'Mark B' for identification, reserving exhibit marking until formal proof.
