Setting aside and striking out interrogatories
Full Text
Any interrogatories may be set aside on the ground that they have been exhibited unreasonably or vexatiously, or struck out on the ground that they are prolix, oppressive, unnecessary or scandalous; and any application for this purpose may be made within seven days after service of the interrogatories.
Plain English Summary
Authorizes the interrogated party to apply within 7 days of service to set aside or strike out interrogatories that are unreasonable, vexatious, prolix, oppressive, unnecessary, or scandalous.
Key Legal Elements
- Strict 7-Day Limitation: Application to set aside/strike out must be moved within 7 days of receiving the interrogatories.
- Two Judicial Remedies: (1) Set aside in whole (unreasonable/vexatious); (2) Strike out in part (prolix, oppressive, scandalous).
- Alternative to Rule 6: Litigant can either object in the answer affidavit (Rule 6) or proactively challenge them under Rule 7.
Practical Note
Application to Strike Out: 'Application on behalf of Defendant No. 1 under Order XI Rule 7 read with Section 151 CPC for Striking Out Interrogatories Nos. 4, 6 and 9 as Oppressive, Prolix, and Scandalous'. Ensure it is moved within 7 days, as delay may forfeit the right to apply under Rule 7.
