Objections to interrogatories by answer

Full Text

Any objection to answering any interrogatory on the ground that it is scandalous or irrelevant or not exhibited bona fide for the purpose of the suit, or that the matters inquired into are not sufficiently material at that stage, or on the ground of privilege or any other ground, may be taken in the affidavit in answer.

Plain English Summary

Permits the interrogated party to raise objections against answering any question directly within their reply affidavit on grounds of irrelevancy, scandal, bad faith, prematurity, or legal privilege.

Key Legal Elements

  • Statutory Grounds of Objection: Scandalous, irrelevant, not bona fide, premature, or legally privileged.
  • Legal Professional Privilege: Communications protected under Sections 126–129 Evidence Act (BSA Sections 132–135).
  • Taken in Answer Affidavit: Objections can be incorporated directly into the verified reply without moving a separate strike-out motion.

Practical Note

Asserting Privilege: When objecting to production or interrogatories regarding advocate-client communication, state explicitly: 'Interrogatory No. 3 is objected to as privileged under Section 126 of the Evidence Act / Section 132 BSA, being confidential legal advice between the defendant and its counsel'.
