Section 5Procedural

Application of the Code to Revenue Courts

Full Text

(1) Where any Revenue Courts are governed by the provisions of this Code in those matters of procedure upon which any special enactment applicable to them is silent, the State Government may, by notification in the Official Gazette, declare that any portions of those provisions which are not expressly made applicable by this Code shall not apply to those Courts, or shall only apply to them with such modifications as the State Government may prescribe.

(2) "Revenue Court" in sub-section (1) means a Court having jurisdiction under any local law to entertain suits or other proceedings relating to the rent, revenue or profits of land used for agricultural purposes, but does not include a Civil Court having original jurisdiction under this Code to try such suits or proceedings as being suits or proceedings of a civil nature.

Plain English Summary

Section 5 empowers State Governments to notify which provisions of the CPC apply, with or without modifications, to Revenue Courts when local revenue laws are silent. It defines Revenue Courts as tribunals dealing with agricultural rent, revenue, or land profits, distinguishing them from ordinary Civil Courts.

Key Legal Elements

  • Default Procedural Applicability: CPC applies to Revenue Courts where specific local revenue enactments are silent.
  • State Government's Power to Modify/Exclude: State Governments may issue gazette notifications to exclude or modify specific CPC provisions for Revenue Courts.
  • Definition of Revenue Court (Sec 5(2)): Courts exercising local statutory jurisdiction over rent, revenue, or profits of agricultural land.
  • Exclusion of Civil Courts: Ordinary Civil Courts trying disputes of a civil nature are distinct and excluded from the scope of Revenue Courts.

Practical Note

In agricultural land and tenancy litigations (such as mutation, partition of agricultural holdings, or ejectment of tenants), the State Land Revenue Code or Tenancy Act is the primary authority. Only where the local revenue enactment is silent does the CPC serve as a supplementary procedural framework, subject to any state government gazette exclusions.
