Execution of decrees passed by Revenue Courts in places to which this Code does not extend
Full Text
The State Government may, by notification in the Official Gazette, declare that the decrees of any Revenue Court in any part of India to which the provisions of this Code do not extend, or any class of such decrees, may be executed in the State as if they had been passed by Courts in that State.
Plain English Summary
Section 44 empowers State Governments to notify in the Official Gazette that decrees passed by Revenue Courts located in non-CPC parts of India may be recognized and executed within that State as if they were decrees passed by domestic courts of that State.
Key Legal Elements
- Revenue Court Decrees: Applies to decrees rendered by Revenue Courts in non-CPC territories of India.
- State Gazette Notification: Enforceability is conditioned upon a formal notification by the State Government.
- Legal Fiction of Domestic Issuance: Notified decrees are executed as if originally passed by the Courts of that State.
- Inter-State Administrative Reciprocity: Facilitates recovery of revenue and agricultural tenancy dues across state lines.
Practical Note
Recognition of External Revenue Adjudications: (1) State Notification Mandatory: Unlike Section 43, enforceability under Section 44 strictly requires a prior State Government Gazette notification declaring reciprocal recognition for revenue court decrees (e.g. agricultural rent or tenancy adjudications). (2) Deemed Domestic Execution: Once notified, such revenue decrees are enforced by local civil/revenue courts without requiring a fresh suit on the judgment.
