Execution of decrees passed by Civil Courts in places to which this Code does not extend

Full Text

Any decree passed by any Civil Court established in any part of India to which the provisions of this Code do not extend, or by any Court established or continued by the authority of the Central Government outside India, may, if it cannot be executed within the jurisdiction of the Court by which it was passed, be executed in the manner herein provided within the jurisdiction of any Court in the territories to which this Code extends.

Plain English Summary

Section 43 facilitates the execution within CPC-governed Indian territories of decrees passed by civil courts located in non-CPC areas of India or by Central Government-established courts outside India, provided such decrees cannot be satisfied within their originating jurisdiction.

Key Legal Elements

  • Originating Courts: Civil courts in non-CPC Indian territories or Central Government-established courts abroad.
  • Inability to Execute Locally: Prerequisite that the decree cannot be satisfied within the passing court's own jurisdiction.
  • Enforceability in CPC Territories: Executed as if transmitted under the Code within competent Indian civil courts.
  • Domestic Extra-Territorial Integration: Ensures civil judgments from exempted areas are fully enforceable across India.

Practical Note

Enforcement of Extra-Territorial and Tribal/Special Area Decrees: (1) Scope & Application: Applies to decrees from Indian territories exempted from the CPC (e.g. tribal areas, autonomous district council courts) and consular/extraterritorial courts operated by the Government of India abroad. (2) Condition Precedent: The decree-holder must establish that satisfaction cannot be obtained in the originating forum because the debtor or assets reside in CPC-governed India. (3) Mechanism: Handled under the execution procedure of Order XXI by transmitting to the destination District Court. (4) Distinct from Section 44A: Section 43 governs Indian non-CPC areas and sovereign Indian tribunals abroad, whereas Section 44A governs foreign national courts in notified reciprocating countries.
