Costs for causing delay
Full Text
(1) If, on any date fixed for the hearing of a suit or for taking any step therein, a party to the suit—
(a) fails to take the step which he was required by or under this Code to take on that date, or
(b) obtains an adjournment for taking such step or for producing evidence or on any other ground,
the Court may, for reasons to be recorded, make an order requiring such party to pay to the other party such costs as would, in the opinion of the Court, be reasonably sufficient to reimburse the other party in respect of the expenses incurred by him in attending the Court on that date, and payment of such costs, on the date next following the date of such order, shall be a condition precedent to the further prosecution of—
(a) the suit by the plaintiff, where the plaintiff was ordered to pay such costs,
(b) the defence by the defendant, where the defendant was ordered to pay such costs.
Explanation.—Where separate defences have been raised by the defendant or groups of defendants, payment of such costs shall be a condition precedent to the further prosecution of the defence by such defendants or groups of defendants as have been ordered by the Court to pay such costs.
(2) The costs, ordered to be paid under sub-section (1), shall not, if paid, be included in the costs awarded in the decree passed in the suit; but, if such costs are not paid, a separate order shall be drawn up indicating the amount of such costs and the names and addresses of the persons by whom such costs are payable and the order so drawn up shall be executable against such persons.
Plain English Summary
Section 35B empowers civil courts to penalize unnecessary adjournments or failure to take prescribed steps by awarding day costs to reimburse the attending opponent. The timely payment of such costs on the very next hearing date is a mandatory condition precedent, default of which operates to bar the plaintiff from prosecuting the suit or the defendant from defending it, with unpaid costs directly executable as an independent decree.
Key Legal Elements
- Grounds for Imposition: Failure to take a prescribed procedural step or seeking an adjournment on the date of hearing.
- Compensatory Reimbursement: Costs designed to reimburse the opponent's actual expenses for court attendance.
- Condition Precedent: Mandatory payment on the next subsequent hearing date as a prerequisite to continuing the suit or defence.
- Direct Executability (Sec 35B(2)): Unpaid costs are drawn up as an independent executable order enforceable under Order XXI.
Punishment
Adjournment costs reimburseable to opposite party; payment is condition precedent to further prosecution of suit/defence; executable on default (Sec 35B)
Practical Note
Daily trial tactic and enforcement of adjournment costs: (1) Condition Precedent Rule: Payment of day costs ordered under Section 35B is mandatory. On the next hearing date, before the defaulting party is permitted to lead evidence or argue, costs must be tendered. If the plaintiff defaults, the suit can be dismissed; if the defendant defaults, their defense can be closed/struck off. (2) Judicial Discretion to Extend: In genuine hardship, courts retain discretion under Section 148 CPC to grant a short extension of time (Salem Advocate Bar Association), but persistent non-payment mandates striking out defence. (3) Direct Executability (Sec 35B(2)): If unpaid, a formal executable order is drawn up against the defaulting party and executed directly under Order XXI. (4) Distinct from Decree: Once paid, Section 35B costs are not pooled into the final costs of the decree.
(क) वादी द्वारा वाद का, जहां वादी को ऐसे खर्चे संदत्त करने का आदेश दिया गया था;
