Section 3Procedural

Subordination of Courts

Full Text

For the purposes of this Code, the District Court is subordinate to the High Court, and every Civil Court of a grade inferior to that of a District Court and every Court of Small Causes is subordinate to the High Court and District Court.

Plain English Summary

Section 3 establishes the hierarchy of civil courts, specifying that District Courts are subordinate to the High Court, while inferior Civil Courts and Courts of Small Causes are subordinate to both the District Court and the High Court.

Key Legal Elements

  • District Court is directly subordinate to the High Court.
  • Inferior Civil Courts (e.g., Civil Judge Junior/Senior Division) are subordinate to both the High Court and the District Court.
  • Courts of Small Causes are subordinate to both the High Court and the District Court.
  • Defines the supervisory and administrative hierarchy for appeals, revisions, and transfer of civil proceedings.

Practical Note

This statutory subordination is critical for procedural remedies such as transfer of suits under Section 24 and revision petitions under Section 115. When seeking transfer between two courts in the same district, an application must first be moved before the District Judge rather than invoking the High Court.
