Section 127PopularProcedural

Publication of rules

Full Text

Rules so made and approved shall be published in the Official Gazette, and shall from the date of publication or from such other date as may be specified have the same force and effect, within the local limits of the jurisdiction of the High Court which made them, as if they had been contained in the First Schedule.

Plain English Summary

Section 127 provides that rules made and approved under Part X must be published in the Official Gazette, conferring upon them full statutory force and effect within the High Court's jurisdiction from the date of publication as if originally enacted in the First Schedule.

Key Legal Elements

  • Mandatory Official Gazette Publication: Must be formally promulgated in the Official Gazette.
  • Operative Date: Becomes effective from the date of publication or any prospective date specified therein.
  • Equal Status with First Schedule: Possesses the same binding force and effect as if enacted in the First Schedule.
  • Territorial Confinement: Binding exclusively within the territorial limits of the High Court that framed them.

Practical Note

Promulgation & Operative Date of State CPC Amendments: (1) Publication in Official Gazette is Mandatory: Gazette notification is the operative event conferring statutory status on High Court amendments. (2) Territorial Force: Unlike parliamentary amendments which apply pan-India, rules notified under Section 127 operate strictly within the territorial jurisdiction of that specific High Court. (3) Complete Replacement: Once published, the modified rule substitutes or modifies the corresponding First Schedule rule for all civil litigation within that State.
