Power of other High Courts to make rules
Full Text
High Courts, other than the Courts specified in section 122, may exercise the powers conferred by that section in such manner and subject to such conditions as the State Government may determine:
Provided that any such High Court may, after previous publication, make a rule extending within the local limits of its jurisdiction any rules which have been made by any other High Court.
Plain English Summary
Section 125 extends rule-making powers to other High Courts (such as historical Judicial Commissioners or newly reorganized High Courts) subject to conditions determined by the State Government, and authorizes adoption of procedural rules already framed by other High Courts.
Key Legal Elements
- Extended Rule-Making Authority: Applies to High Courts not covered under Section 122.
- State Executive Conditions: Exercisable in the manner and subject to conditions determined by the State Government.
- Adoption of Sister High Court Rules (Proviso): Authorizes extending rules framed by any other High Court after previous publication.
Practical Note
Inter-High Court Rule Adoption & Reorganization Provisions: Section 125 enabled newly created High Courts or transitional judicial commissioners' courts to adopt well-tested civil rules from established High Courts (e.g. adopting Bombay or Punjab High Court Rules) without reinventing comprehensive procedural frameworks from scratch.
