Section 124Procedural

Committee to report to High Court

Full Text

Every Rule Committee shall make a report to the High Court established at the town at which it is constituted on any proposal to annul, alter or add to the rules in the First Schedule or to make new rules, and before making any rules under section 122 the High Court shall take such report into consideration.

Plain English Summary

Section 124 makes it mandatory for the statutory Rule Committee to examine and report on any proposed amendments or additions to procedural rules, requiring the High Court to formally consider this report before exercising its rule-making powers under Section 122.

Key Legal Elements

  • Mandatory Reporting Obligation: Rule Committee must submit a formal written report on any proposal to amend, add to, or annul procedural rules.
  • Scope of Review: Covers alterations to First Schedule rules as well as completely new procedural codes.
  • Compulsory Judicial Consideration: High Court is statutorily bound to consider the Rule Committee's report before enacting rules under Section 122.

Practical Note

Mandatory Consultative Process in Judicial Rule-Making: High Courts cannot arbitrarily alter First Schedule Orders without institutional deliberation. Section 124 ensures that the views of the Bar and the subordinate judiciary (represented on the Rule Committee under Section 123) are formally analyzed in a written report and tabled before the Full Court of the High Court before any draft rule is approved.
