Library/CPC/Section 122
Section 122PopularProcedural

Power of certain High Courts to make rules

Full Text

High Courts not being the Court of a Judicial Commissioner may, from time to time after previous publication, make rules regulating their own procedure and the procedure of the Civil Courts subject to their superintendence, and may by such rules annul, alter or add to all or any of the rules in the First Schedule.

Plain English Summary

Section 122 empowers High Courts, after previous publication, to frame rules regulating their own procedure and that of subordinate civil courts, with full authority to annul, amend, or add to any of the procedural rules in the First Schedule.

Key Legal Elements

  • Authority to Regulate Procedure: High Courts may frame rules governing their own procedure and all subordinate civil courts.
  • Power to Annul, Alter, or Add: High Courts can directly modify or repeal procedural rules in the First Schedule.
  • Mandatory Previous Publication: Proposed rules must undergo prior official publication for stakeholder scrutiny.
  • Adaptability to Local Needs: Accommodates regional administrative requirements, court efficiency, and technological modernizations.

Practical Note

High Court Rule-Making Power, Local Amendments & State Variations: (1) Origin of High Court Amendments: The diverse State Amendments observed across Orders of the CPC (e.g. state-specific variations in Order XXI execution rules, Order V service rules, or Order VIII written statement filings) derive their statutory validity from Section 122. (2) Mandatory Condition — Previous Publication: Under Section 122 read with Section 23 of the General Clauses Act, 'previous publication' in the Official Gazette inviting public and bar objections is mandatory before any rule amendment becomes effective. (3) Annulment and Addition Power: High Courts can not only alter existing rules but can annul entire rules or add new sub-rules to suit local practices and technological advancements (such as e-filing rules and video conferencing rules).
