Section 121PopularProcedural

Effect of rules in First Schedule

Full Text

The rules in a First Schedule shall have effect as if enacted in the body of this Code until annulled or altered in accordance with the provisions of this Part.

Plain English Summary

Section 121 establishes the statutory force of the rules contained in the First Schedule (Orders 1 to 51), declaring that they carry the full force of law as if enacted within the substantive body of the Code until amended, annulled, or altered under Part X.

Key Legal Elements

  • Full Statutory Force: Rules in the First Schedule possess the exact same legal efficacy as if enacted in the body of the Code.
  • Conditional Duration: Operates with binding force until formally altered, added to, or annulled under Part X.
  • Foundation of Procedural Flexibility: Distinguishes between fundamental legislative principles (Sections) and adaptable judicial procedure (Orders/Rules).

Practical Note

Dual Architecture of CPC & Substantive Sections vs Procedural Rules: (1) Architecture of CPC: The Code of Civil Procedure is split into two distinct parts: (i) the substantive Body consisting of 158 Sections, which can only be amended by Parliament or State Legislatures, and (ii) the First Schedule consisting of 51 Orders and procedural Rules, which can be modified, added to, or annulled by High Courts under Part X (Sections 122–130). (2) Statutory Parity: Section 121 clarifies that despite being procedural rules capable of judicial alteration, the First Schedule rules carry the identical statutory force and binding effect as the sections themselves until formally altered (*Iridium India Telecom Ltd. v. Motorola Inc., 2005*). (3) Subordination to Sections: If an irreconcilable conflict arises between a Section in the body of the Code and a Rule in the First Schedule, the Section prevails.
