Public and private documents

Full Text

(1) The following documents are public documents:—

  • (a) documents forming the acts, or records of the acts—
    • (i) of the sovereign authority;
    • (ii) of official bodies and tribunals; and
    • (iii) of public officers, legislative, judicial and executive of India or of a foreign country;
  • (b) public records kept in any State or Union territory of private documents.

(2) All other documents except the documents referred to in sub-section (1) are private.

(1) निम्नलिखित दस्तावेज़ सार्वजनिक दस्तावेज़ (public documents) हैं:—

  • (क) निम्नलिखित के कार्यों या कार्यों के अभिलेख बनाने वाले दस्तावेज़—
    • (i) संप्रभु प्राधिकारी (sovereign authority) के;
    • (ii) आधिकारिक निकायों और न्यायाधिकरणों के; और
    • (iii) भारत के या किसी विदेशी देश के विधायी, न्यायिक और कार्यकारी सार्वजनिक अधिकारियों के;
  • (ख) निजी दस्तावेजों के किसी भी राज्य या केंद्र शासित प्रदेश में रखे गए सार्वजनिक रिकॉर्ड।

(2) उप-धारा (1) में निर्दिष्ट दस्तावेजों को छोड़कर अन्य सभी दस्तावेज़ निजी (private) हैं।
