Section 526Administrative
Practising advocate not to sit as Magistrate in certain Courts
Full Text
No advocate who practices in the Court of any Magistrate shall sit as a Magistrate in that Court or in any Court within the local jurisdiction of that Court.
Plain English Summary
Prevents professional conflict of interest by prohibiting an advocate from acting as a Magistrate in the same jurisdiction where they practice law.
Key Legal Elements
- Conflict of interest prevention
- Restriction on dual roles: Advocate and Magistrate
- Jurisdictional prohibition
Practical Note
This ensures neutrality. A person cannot be a lawyer and a judge in the same court complex, as it would compromise the appearance of impartiality.
