Appeal to Court of Session how heard
Full Text
(1) Subject to the provisions of sub-section (2), an appeal to the Court of Session or Sessions Judge shall be heard by the Sessions Judge or by an Additional Sessions Judge:
Provided that an appeal against a conviction on a trial held by a Magistrate of the second class may be heard and disposed of by the Chief Judicial Magistrate.
(2) An Additional Sessions Judge or a Chief Judicial Magistrate shall hear only such appeals as the Sessions Judge of the division may, by general or special order, make over to him or as the High Court may, by special order, direct him to hear.

(1) उपधारा (2) के प्रावधानों के अधीन, सत्र न्यायालय या सत्र न्यायाधीश को अपील की सुनवाई सत्र न्यायाधीश द्वारा या अपर सत्र न्यायाधीश द्वारा की जाएगी:
परंतु द्वितीय वर्ग मजिस्ट्रेट द्वारा किए गए विचारण में दोषसिद्धि के विरुद्ध अपील की सुनवाई मुख्य न्यायिक मजिस्ट्रेट द्वारा की जा सकती है और उसका निपटारा किया जा सकता है।
(2) अपर सत्र न्यायाधीश या मुख्य न्यायिक मजिस्ट्रेट केवल उन्हीं अपीलों की सुनवाई करेगा जिन्हें उस खंड का सत्र न्यायाधीश, सामान्य या विशेष आदेश द्वारा, उसे सौंपता है या जिन्हें उच्च न्यायालय, विशेष आदेश द्वारा, उसे सुनने का निर्देश देता है।
