Section 421Procedural

Special right of appeal in certain cases

Full Text

Notwithstanding anything in this Chapter, when more persons than one are convicted in one trial, and an appealable judgment or order has been passed in respect of any of such persons, all or any of the persons convicted at such trial shall have a right of appeal.

Plain English Summary

Ensures that if one person in a joint trial has a right to appeal, all co-convicts in that trial also gain the right to appeal.

Key Legal Elements

  • Applicable to joint trials of multiple persons
  • Triggered if any co-convict has a right to appeal
  • Grants right of appeal to all convicted persons in that trial
  • Overrides individual limitations on petty sentences

Practical Note

This is a critical provision for joint trials. If a co-accused gets a right to appeal because of a higher sentence, others convicted with lower, non-appealable sentences in the same trial also get the right to appeal. This maintains judicial consistency.
