- (i) if the conviction is by a High Court; or
- (ii) if the conviction is by a Court of Session or Magistrate of the first or second class, except as to the extent or legality of the sentence.
Plain English Summary
Restricts appeals when an accused pleads guilty, allowing challenges only to the legality or extent of the sentence in lower courts.
Key Legal Elements
- No appeal against conviction on plea of guilt
- Limited appeal allowed against sentence legality/extent
- Applies to Sessions Courts and Magistrates
- Absolute bar on appeals from High Court guilty plea convictions
Practical Note
A plea of guilt is considered a waiver of the right to challenge the conviction. However, judicial oversight remains available to ensure the sentence imposed follows the law and is not excessive.
