Section 296Procedural

Power of Court in plea bargaining

Full Text

A Court shall have, for the purposes of discharging its functions under this Chapter, all the powers vested in respect of bail, trial of offences and other matters relating to the disposal of a case in such Court under this Sanhita.

Plain English Summary

Confirms that the Court retains all its regular judicial powers while handling plea bargaining applications.

Key Legal Elements

  • Court retains all existing powers related to bail, trial, and disposal of cases while conducting plea bargaining
  • Plea bargaining doesn't limit the Court's inherent procedural authority

Practical Note

This section clarifies that plea bargaining is an 'addition' to the court's toolkit, not a separate process that strips away its power. For instance, the Court can still grant bail or pass necessary orders while the plea bargaining negotiation is ongoing.
