The judgment delivered by the Court under this section shall be final and no appeal (except the special leave petition under article 136 and writ petition under articles 226 and 227 of the Constitution) shall lie in any Court against such judgment.
Plain English Summary
Declares plea bargaining judgments as final and non-appealable, with constitutional remedies being the only exceptions.
Key Legal Elements
- Judgment delivered in plea bargaining is FINAL
- NO regular appeal is allowed against such judgment
- EXCEPTIONS: Special Leave Petition (SLP) under Article 136 of the Constitution
- EXCEPTIONS: Writ Petitions under Articles 226 and 227 of the Constitution
Practical Note
One of the core reasons plea bargaining is effective is its finality. Since the parties reached a mutual agreement, they waive their right to appeal. The only way to challenge it is through the extraordinary powers of the High Court or Supreme Court if there was a major legal error or violation of fundamental rights.
