Judgment in cases tried summarily

Full Text

In every case tried summarily in which the accused does not plead guilty, the Magistrate shall record the substance of the evidence and a judgment containing a brief statement of the reasons for the finding.

Plain English Summary

Mandates that for contested summary trials, the Magistrate must record the substance of the evidence and brief reasons for the judgment.

Key Legal Elements

  • Required only if the accused does NOT plead guilty
  • Magistrate must record the substance of the evidence
  • Judgment must contain a brief statement of the reasons for the finding

Practical Note

Even in a summary trial, the Magistrate cannot simply say 'guilty' or 'not guilty' if the trial was contested. They must provide a concise reasoning for their decision and summarize the evidence presented. This ensures transparency and provides a basis for appeal if needed.
