Section 221Procedural

Cognizance of offence

Full Text

221. Cognizance of offence.— No Court shall take cognizance of an offence punishable under section 67 of the Bharatiya Nyaya Sanhita, 2023 where the persons are in a marital relationship, except upon prima facie satisfaction of the facts which constitute the offence upon a complaint having been filed or made by the wife against the husband.

Plain English Summary

Requires a complaint by the wife and prima facie satisfaction of the court for taking cognizance of sexual intercourse by a husband during separation (BNS 67).

Key Legal Elements

  • Offence: Sexual intercourse during separation (BNS Section 67).
  • Marital Relationship: Applies specifically to married couples during separation.
  • Complaint Source: Must be filed by the wife.
  • Court Prerequisite: Prima facie satisfaction of facts constitutes a mandatory condition.

Practical Note

This is a specific procedural safeguard for Section 67 of BNS. Unlike many other sexual offences where a police report might suffice, this requires the wife's personal complaint and judicial scrutiny of facts at the earliest stage.
