Library/BNSS/Section 197
Section 197PopularProcedural

Ordinary place of inquiry and trial

Full Text

Every offence shall ordinarily be inquired into and tried by a Court within whose local jurisdiction it was committed.

Plain English Summary

Defines the basic territorial jurisdiction: an offence is tried where it is committed.

Key Legal Elements

  • Territorial jurisdiction based on commission of offence
  • The Ordinary Place rule
  • Default venue for inquiry and trial

Punishment

Jurisdictional rule (Locus).

This is the default rule of jurisdiction. If a theft occurs in Delhi, the Delhi courts have jurisdiction. However, the word "ordinarily" allows for exceptions detailed in subsequent sections.
