(1) Any officer in charge of a police station may, without the order of a Magistrate, investigate any cognizable case. The SP may require a DSP to investigate based on nature/gravity.
(2) Proceedings cannot be questioned on jurisdiction grounds.
(3) A Magistrate can order an investigation based on an application supported by an affidavit and after inquiry.
(4) Public Servant Safeguard: Investigation against public servants for official duties requires (a) a superior officer’s report and (b) consideration of the servant’s version of the incident.

(1) पुलिस अधिकारी बिना मजिस्ट्रेट के आदेश के अपने क्षेत्राधिकार के भीतर किसी भी संज्ञेय अपराध की जांच कर सकते हैं। एसपी गंभीर मामलों की जांच के लिए डीएसपी को भी नियुक्त कर सकते हैं।
(2) पुलिस की जांच कार्यवाही को बाद में क्षेत्रीय क्षेत्राधिकार की कमी के आधार पर चुनौती नहीं दी जा सकती।
(3) एक मजिस्ट्रेट आवेदन (शपथ पत्र के साथ) पर विचार करने और पुलिस की बात सुनने के बाद जांच का आदेश दे सकता है।
(4) लोक सेवकों के लिए विशेष सुरक्षा: यदि शिकायत किसी लोक सेवक के खिलाफ उसके आधिकारिक कर्तव्य के दौरान की गई कार्रवाई के लिए है, तो मजिस्ट्रेट केवल तभी जांच का आदेश दे सकता है जब: (a) उसके वरिष्ठ अधिकारी से रिपोर्ट प्राप्त हो जाए; और (b) घटना के संबंध में लोक सेवक के स्पष्टीकरण पर विचार कर लिया जाए।
