Criminal conspiracy

61. (1) When two or more persons agree with the common object to do, or cause to be done––

(a) an illegal act; or

(b) an act which is not illegal by illegal means, such an agreement is designated a criminal conspiracy:

Provided that no agreement except an agreement to commit an offence shall amount to a criminal conspiracy unless some act besides the agreement is done by one or more parties to such agreement in pursuance thereof.

Explanation.—It is immaterial whether the illegal act is the ultimate object of such agreement, or is merely incidental to that object.

(2) Whoever is a party to a criminal conspiracy,––

(a) to commit an offence punishable with death, imprisonment for life or rigorous imprisonment for a term of two years or upwards, shall, where no express provision is made in this Sanhita for the punishment of such a conspiracy, be punished in the same manner as if he had abetted such offence;

(b) other than a criminal conspiracy to commit an offence punishable as aforesaid shall be punished with imprisonment of either description for a term not exceeding six months, or with fine or with both.

To prove criminal conspiracy, direct evidence of agreement is rarely available. The prosecution must establish a meeting of minds through circumstantial evidence, conduct, and acts done in pursuance of the agreement. For minor offenses, an overt act besides the agreement must be proved.

61. (1) जब दो या दो से अधिक व्यक्ति निम्नलिखित कार्य करने या करवाने के लिए सामान्य उद्देश्य से सहमत होते हैं, तो ऐसे समझौते को आपराधिक षड्यंत्र कहा जाता है:—

(क) कोई अवैध कार्य; या

(ख) ऐसा कार्य जो अवैध नहीं है, लेकिन उसे अवैध साधनों द्वारा किया जाए:

परंतु किसी अपराध को करने के समझौते के अलावा कोई अन्य समझौता तब तक आपराधिक षड्यंत्र नहीं माना जाएगा, जब तक कि उस समझौते के अनुसरण में एक या अधिक पक्षकारों द्वारा समझौते के अलावा कोई कार्य न किया गया हो।

स्पष्टीकरण—यह मायने नहीं रखता कि अवैध कार्य उस समझौते का अंतिम उद्देश्य है या केवल उस उद्देश्य के लिए आनुषंगिक है।

(2) जो कोई भी आपराधिक षड्यंत्र में शामिल होता है, उसे:—

(क) यदि षड्यंत्र किसी ऐसे अपराध को करने के लिए है जो मृत्युदंड, आजीवन कारावास या दो वर्ष या उससे अधिक के कठिन कारावास से दंडनीय है, और जहां इस संहिता में ऐसे षड्यंत्र के दंड के लिए कोई स्पष्ट प्रावधान नहीं है, तो उसे उसी प्रकार दंडित किया जाएगा जैसे उस अपराध के दुष्प्रेरण के लिए दंड मिलता है;

(ख) उपर्युक्त अपराधों के अलावा अन्य किसी आपराधिक षड्यंत्र के मामले में, उसे छह महीने तक के किसी भी अवधि के कारावास, या जुर्माने, या दोनों से दंडित किया जाएगा।
