Full Text
40. Commencement and continuance of the right of private defence of the body.
The right of private defence of the body commences as soon as a reasonable apprehension of danger to the body arises from an attempt or threat to commit the offence though the offence may not have been committed; and it continues as long as such apprehension of danger to the body continues.
Plain English Summary
This section specifies that the right of private defence of the body starts as soon as a reasonable apprehension of danger arises and lasts as long as that apprehension continues.
Key Legal Elements
- Commences as soon as a reasonable apprehension of danger to the body arises from an attempt or threat.
- The offence itself does not need to have been committed yet.
- Continues as long as the apprehension of danger to the body continues.
Practical Note
This replaces IPC Section 102. You do not have to wait for the first blow to land. A credible threat is enough to trigger the right, but once the threat is gone, the right terminates (you cannot retaliate).
