Consent known to be given under fear or misconception.

A consent is not such a consent as is intended by any section of this Sanhita, if the consent is given by a person under fear of injury, or under a misconception of fact, and if the person doing the act knows, or has reason to believe, that the consent was given in consequence of such fear or misconception; or \nConsent of person of mental illness or intoxicated.— if the consent is given by a person who, from mental illness, or intoxication, is unable to understand the nature and consequence of that to which he gives his consent; or \nConsent of child.— unless the contrary appears from the context, if the consent is given by a person who is under twelve years of age.

कोई सम्मति ऐसी सम्मति नहीं है जैसा कि इस संहिता की किसी धारा द्वारा आशयित है, यदि वह सम्मति किसी व्यक्ति द्वारा क्षति के भय के या तथ्य की भूल के अधीन दी गई हो, और यदि कार्य करने वाला व्यक्ति यह जानता हो या उसके पास यह विश्वास करने का कारण हो कि वह सम्मति ऐसे भय या भूल के परिणामस्वरूप दी गई थी ; या\nमानसिक बीमारी वाले या मत्त व्यक्ति की सम्मति— यदि वह सम्मति ऐसे व्यक्ति द्वारा दी गई हो जो मानसिक बीमारी या मत्तता के कारण उस बात की प्रकृति और परिणाम को, जिसके लिए वह अपनी सम्मति देता है, समझने में असमर्थ हो ; या\nबालक की सम्मति— जब तक कि संदर्भ से इसके उलट न प्रतीत हो, यदि वह सम्मति ऐसे व्यक्ति द्वारा दी गई हो जो बारह वर्ष से कम आयु का हो ।
